PURPOSE AND SCOPE OF PROPOSAL It is the intent of East Detroit Public Schools to incorporate consolidated purchasing of custodial chemicals and supplies as listed to a Single-Source Supply Agreement. This will encompass all facilities of East Detroit Public Schools, and any applicable products that may be provided under the terms of the Agreement. Supplier shall maintain all records for a period of five (5) years from the date the record is made. Supplier shall give East Detroit Public Schools, or its authorized representative, the privilege of inspecting, examining and auditing without notice, during normal business hours, Supplier business records that are relevant to this agreement. The cost of such inspection, examination, and audit will be at the sole expense of East Detroit Public Schools. Upon entering into a contract with East Detroit Public Schools, the successful Supplier(s) shall not assign or delegate any obligation to another Supplier without written consent of East Detroit Public Schools. All subcontractors supplying products must be identified within the proposal including name, address, phone number and products to be supplied. Unless specifically authorized in writing by the East Detroit Public Schools’ Business Services Department on a case by case basis, the successful Supplier shall have no right to use, and shall not use, the name of East Detroit Public Schools, or its officials or employees; (a) in advertising, publicity, or promotion; nor (b) to express or imply any endorse mere of the Supplier products or services. The handling and delivery of all products shall be in accordance with all Federal, State, Local and East Detroit Public Schools requirements. While preset on the East Detroit Public Schools grounds, the Supplier, including all employees and agents, agrees to abide by, and comply with all East Detroit Public Schools, federal, state and local policies, regulations, and laws that pertain to sexual harassment and non-discrimination. The Supplier shall be proactive in assuring that applicants, employees, and customers are treated fairly without regard to, or in discrimination of their race, religion sex, national origin, marital status, age, sexual orientation, veteran status, or disability. Supplier further agrees that Supplier employees and agents while on (School District’s) premises, shall comply with and observe all applicable rules and regulations concerning conduct which are imposed upon (School District’s) employees and agents. All East Detroit Public Schools facilities are smoke-free. The East Detroit Public Schools requires that the supplies used and/or purchased with respect to this proposal be manufactured in the United States. It is the bidder's responsibility to show such supplies are manufactured in the United States. If the supplies provided by the bidder are not manufactured in the United States, the bidder must show that one of the following is true: (1) The supplies required to comply with the proposal are not manufactured in the United States in a reasonably available quantity to make a competitive proposal. (2) The price of the supplies required to comply with this proposal exceeds the price of comparable supplies available outside the United States by an unreasonable amount. (3) The quality of the supplies required to comply with this proposal is substantially less than comparably priced supplies available outside the United States. The East Detroit Public Schools may require the successful bidder to provide documentation of the stated reasons why U.S.-manufactured supplies were not used or purchased.
